ANTI-SPAM POLICY

This Anti-Spam Policy (“Policy”) governs the creation, transmission, and management of electronic communications by Edgar Allen Marketing (“Company,” “we,” “us,” or “our”) in connection with edgarallenmarketing.us (the “Website”) and all related services, platforms, and communications.
This Policy is designed to ensure compliance with applicable global anti-spam and electronic communications laws, including but not limited to:

Canada’s CASL
The EU GDPR and ePrivacy Directive
Other applicable international anti-spam regulations
1. DEFINITIONS
1.1 Commercial Electronic Message (“CEM”)
A Commercial Electronic Message is any electronic message (including email, SMS, MMS, direct message, or similar communication) that has as one of its purposes the encouragement of participation in a commercial activity, whether or not a commercial transaction actually occurs.
1.2 Consent
Consent means a recipient’s voluntary, informed, and affirmative agreement to receive Commercial Electronic Messages from Edgar Allen Marketing.
Consent may be:
Express Consent – explicit opt-in (e.g., checkbox, form submission, written request)
Implied Consent – only where legally permitted and time-limited
Where required by law, express consent is mandatory.
1.3 Unsubscribe Request
An Unsubscribe Request is any communication or action by which a recipient indicates they no longer wish to receive Commercial Electronic Messages, including clicking an unsubscribe link or sending a direct request.
2. CONSENT REQUIREMENTS
Edgar Allen Marketing maintains a strict opt-in policy.
We:
Require express, affirmative consent before sending CEMs where required by law
Do not purchase, rent, or harvest email lists
Do not send unsolicited bulk communications
Each opt-in mechanism must clearly disclose:

3. UNSUBSCRIBE & OPT-OUT COMPLIANCE
Every Commercial Electronic Message must include a:
Clear, conspicuous, and functional unsubscribe mechanism
Method that requires no login and no unnecessary steps
Opt-Out Handling
All unsubscribe requests are honored within five (5) business days
Opt-out requests result in perpetual suppression, unless renewed consent is provided
No fees, penalties, or additional obligations are imposed on recipients for opting out
4. MESSAGE CONTENT & TRANSPARENCY REQUIREMENTS
All Commercial Electronic Messages must:
Accurately identify the sender in the “From,” “To,” and routing information
Use truthful, non-deceptive subject lines
Clearly identify the message as commercial where required
Include valid contact information for the sender
Misleading headers, spoofing, falsified routing, or deceptive redirection are strictly prohibited.
5. PROHIBITED PRACTICES
Edgar Allen Marketing strictly prohibits:
Sending messages without lawful consent
Using false or misleading domain names or IP addresses
Disguising or concealing sender identity
Engaging in deceptive routing or relay practices
Continuing to message recipients who have opted out
Violations may result in immediate termination of access or services and legal action.
6. RECORD-KEEPING & AUDIT TRAILS
We maintain reasonable records to demonstrate compliance, including:
Consent capture date, method, and source
Message logs and campaign records
Unsubscribe and suppression lists
Compliance reviews and audits
Records are retained for a commercially reasonable period or as required by law.
7. THIRD-PARTY MAILINGS & DISCLAIMERS
Edgar Allen Marketing may use third-party service providers (e.g., email platforms) to facilitate communications.
However:
We do not authorize third parties to send CEMs on our behalf without compliance
We disclaim liability for unauthorized or non-compliant mailings conducted by third parties outside our control
Third-party partners are contractually required to comply with applicable anti-spam laws
8. REPORTING SPAM OR VIOLATIONS
If you believe you have received a message from us in violation of this Policy, you may report it by contacting:
Reports are investigated promptly and corrective action is taken where appropriate.
9. SEVERABILITY
If any provision of this Policy is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
10. CHOICE OF LAW & JURISDICTION
This Anti-Spam Policy shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict-of-law principles.
